1. Acceptance of these Terms

These Terms and Conditions ("Terms") form a binding agreement between you ("you", "user") and Miraz Mullick, the sole developer and operator of the Wasilah mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not download, install, or use the App.

2. Eligibility

The App is intended for users aged 13 and over (or the equivalent minimum digital-consent age in your jurisdiction). By using the App, you confirm that you meet this age requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Licence to use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on a mobile device that you own or control, for your personal, non-commercial use only.

You agree not to:

  • Copy, modify, adapt, translate, reverse-engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law;
  • Distribute, sell, lease, sub-license, or otherwise transfer the App or any part of it to any third party;
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App;
  • Use the App in any way that violates applicable laws or regulations, infringes the rights of others, or interferes with the operation of the App or its underlying services;
  • Use the App to send spam, phishing, or other unsolicited messages;
  • Attempt to gain unauthorised access to the App's systems, the systems of its third-party service providers, or other users' devices.

4. Religious content disclaimer

Wasilah provides religious content and tools, including but not limited to the text of the Holy Quran, audio recitation, prayer times, the Qibla direction, and duʻa and dhikr collections. We make every reasonable effort to ensure this content is accurate, sourced from established traditions, and presented respectfully. However:

  • Prayer times are computed using mathematical models and astronomical data. While we use established calculation methods (Muslim World League, Egyptian General Authority, Umm al-Qura, ISNA, and others), prayer times depend on your device's reported location, the calculation method you select, and local conditions, and they may differ from times announced by your local mosque. The prayer times shown in the App are guidance only, not a definitive religious ruling.
  • Qibla direction depends on your device's compass and location services. Magnetic interference, miscalibrated sensors, and proximity to metal can cause errors. Always cross-check the direction with a physical compass or local mosque if precise alignment is important.
  • Quran text and translations are sourced from established editions and translators. Translations are interpretive by nature; for matters of religious ruling, consult a qualified scholar.
  • Duʻa and dhikr collections are provided for personal use and reflection.

The App is a tool that supports religious practice; it is not a substitute for scholarly guidance, jurisprudence (fiqh), or in-person consultation with qualified religious authorities.

5. Third-party services

The App relies on the following third-party services to deliver its features:

  • Google Firebase (Crashlytics, Analytics, Cloud Messaging) for stability, usage analytics, and notifications;
  • The AlAdhan API (operated by IslamicNetwork) for prayer-time computation;
  • The islamic.network audio CDN (operated by IslamicNetwork) for Quran recitation streaming.

These services are operated by independent third parties under their own terms and privacy policies. We are not responsible for the availability, accuracy, or content of any third-party service. Your use of any third-party service through the App is also subject to that third party's terms.

6. Intellectual property

The App, including its source code, design, branding, name, logo, and original content, is the property of Miraz Mullick and is protected by copyright, trademark, and other intellectual property laws. The Holy Quran is in the public domain; specific translations, recitations, and editions remain the intellectual property of their respective translators, reciters, and publishers. Open-source components used by the App are licensed under their respective open-source licences.

Nothing in these Terms grants you any rights in or to the App, its content, or its branding except the limited licence set out in Section 3.

7. User feedback

If you submit feedback, suggestions, or feature requests to us (through email, in-app feedback, app store reviews, or any other channel), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use that feedback to improve the App, without obligation to compensate or credit you.

8. App availability and updates

We may release updates, patches, and new features at our discretion. Some updates may be required for the App to continue functioning. We may also modify, suspend, or discontinue any feature at any time. We will not be liable to you or any third party if we exercise this right. The App is provided as a free service; we do not guarantee uninterrupted or error-free operation.

9. No warranty

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that:

  • Prayer times, Qibla direction, or any other religious content will be free from error, perfectly accurate, or suitable for every use;
  • The App will be uninterrupted, secure, or free of bugs;
  • Any defects will be corrected on any particular timeline.

You use the App at your own risk and are solely responsible for verifying any information that affects your religious practice.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Miraz Mullick, the operator of the App, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the App, including without limitation damages for loss of profits, loss of data, loss of goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any and all claims arising out of or relating to the App or these Terms shall not exceed the greater of (a) the amount you have paid to us for the App in the twelve (12) months preceding the claim, or (b) ten US dollars (USD $10). Because the App is provided free of charge, that amount is typically zero.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, our liability is limited to the minimum permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Miraz Mullick from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the App, or your violation of any law or the rights of any third party.

12. Termination

You may stop using the App at any time by uninstalling it from your device. We may terminate or suspend your access to the App at any time, with or without notice, if you breach these Terms or if we are required to do so by law. Provisions of these Terms which by their nature should survive termination (including without limitation Sections 6, 9, 10, 11, and 14) shall survive.

13. Open-source notices

Wasilah uses open-source software components, including (but not limited to) the Flutter framework, the Firebase SDKs, the geolocator plugin, and other libraries. These components are licensed under their respective open-source licences (such as Apache 2.0, BSD, and MIT). Open-source notices and licence texts are available within the App under Settings → About → Open-source licences, or on request from the contact address below.

14. Governing law and dispute resolution

These Terms are governed by the laws of the People's Republic of Bangladesh, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh, except where applicable consumer-protection law in your country of residence requires otherwise.

Nothing in these Terms is intended to deprive you of any mandatory consumer-protection rights you have under the law of your country of residence.

15. Apple App Store additional terms

If you obtained the App from the Apple App Store, the following additional terms apply between you and us, with Apple Inc. ("Apple") as a third-party beneficiary:

  • These Terms are concluded between you and us only, and not with Apple. Apple is not responsible for the App or its content.
  • The licence granted to you in Section 3 is limited to use of the App on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the App.
  • In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligations whatsoever.
  • You and we acknowledge that Apple is not responsible for addressing any claims by you or any third party relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
  • You and we acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you.

16. Google Play additional terms

If you obtained the App from the Google Play Store, your use is also subject to the Google Play Terms of Service. We comply with the Google Play Developer Program Policies in operating the App.

17. Severability and waiver

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.

18. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements between you and us relating to its subject matter.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this document and, where the changes are material, notify you within the App. Continued use of the App after the changes take effect constitutes acceptance of the revised Terms.

They are not legal advice. Before publishing in jurisdictions with additional disclosure requirements (for example, mandatory arbitration disclosures in some US states, or specific consumer-rights disclosures in the EU), review these Terms with a qualified lawyer.
